Das Gericht hat in 2 von 3 Fällen zuungunsten der Kläger entschieden. Die Klägeranwälte wurde u.a. von Nera finanziert (zumindest hab ich das so verstanden).

That said, it’s an exciting time for Nera Capital as a company. The judgment helps shape future market opportunities, and we’re pleased to share that the outcome aligns with the areas we’ve deliberately focused on. While our approach may have been viewed as cautious, we’ve consistently targeted claims involving clear breaches of FCA regulations — particularly around discretionary commission arrangements (DCAs) and lenders’ failure to conduct proper affordability assessments.
The Supreme Court reviewed three claims. Only the Johnson case brought under the unfair relationship provisions of the Consumer Credit Act was successful, with the court confirming the borrower’s right to full redress, including all commissions and interest.
The other two cases, which were not based on that legal framework, were dismissed. Importantly, these types of claims are not ones that Nera supports — further reinforcing that this judgment does not affect our current portfolio.
This outcome validates the strategy we’ve taken from the beginning. We continue to see strong institutional interest and backing for this approach, and we’re excited about the road ahead.
